Terms & Conditions of Sales

1. Purpose

These terms and conditions define the rights and obligations of the parties within the framework of remote booking of services offered by our establishment, whose contact details are specified in this booking confirmation document. They govern all the steps necessary for booking and managing the booking between the contracting parties. The client acknowledges having read and accepted these terms and conditions of sale and the terms and conditions of sale for the reserved rate, accessible on our booking platform. These terms and conditions of sale apply to all bookings made online via our booking platform. The establishment: Trade name = La Villa Hôtel Bien Être / Legal entity = EURL LE LIKA FR80522194802

The Reception is open from 8am to 9pm.

2. Reservation

The customer selects the services presented on our booking platform. They acknowledge having reviewed the nature, destination, and booking procedures for the services available on our platform and having requested and obtained all necessary and/or additional information to make their booking with full knowledge of the facts, whether online or by telephone. The customer is solely responsible for their choice of services and their suitability for their needs; therefore, we cannot be held liable in this regard. The booking is deemed accepted by the customer upon completion of the booking process. All bookings are generated after acceptance of the general terms and conditions of sale.
You also acknowledge having read and accepted these terms and conditions without reservation by finalizing your booking.
The reservation must be guaranteed by credit card.
Room available from 5pm on the day of arrival until 11am on the day of departure. Please let us know if you will be arriving late (after 9pm).
The wellness area is open from Easter to November. In order to preserve our resources and the environment, the pool is only heated when the weather permits swimming, mainly from June to September.

Any observation requiring additional waste management and cleaning services will incur a charge of €30/day, billed in addition to your stay. This is for hygiene and waste management purposes.
Deposit collected after booking and non-transferable, non-refundable without insurance.
When there is Prepayment, it is required at all times, non-transferable, non-refundable except with insurance.
-100% due (deposits or prepayment) at any time; non-transferable non-refundable: Public holidays, Ascension, Pentecost, July and August, and special offers/rates.

- Free cancellation of the reservation up to 15 days before arrival. Beyond that, 50% of the total reservation amount is due within 14 days of arrival.(Excludes bookings including public holidays, Ascension, Pentecost, July and August, special offers/rates)
-Public holidays, Ascension, Pentecost, July and August, and special offers/rates: 100% due (deposits or prepayment) at all times; non-transferable; non-refundable except with insurance.


3. Booking Process

Reservations made by the customer are processed via the online booking form accessible on our booking platform. The reservation is considered confirmed upon receipt of the booking form. Prior to making any reservation, the customer agrees to complete all required information on the booking form or request. The customer attests to the truthfulness and accuracy of the information provided. After the final selection of services to be booked, the booking procedure includes, in particular, entering the credit card details if a deposit or prepayment guarantee is requested, consulting and accepting the general terms and conditions of sale and the terms and conditions of sale of the reserved rate before validating the booking and, finally, validating the booking by the customer.

When you book, your credit card information is registered as a guarantee. After booking, you will receive a payment link via our secure PAYZEN system, which you must follow to complete the transaction using two-factor authentication. If you do not accept this payment, your booking will be automatically cancelled.


4. Booking confirmation

Our booking platform acknowledges receipt of the customer's booking by sending an email without delay. In the case of online or telephone booking, the booking confirmation by email summarizes the contract offer, the services booked, the prices, the terms and conditions of sale relating to the selected rate, accepted by the customer, the date of booking made, information relating to after-sales service, as well as the address of the seller's establishment to which the customer can submit their complaints.


5. Cancellation or modification by the customer

Customers are reminded, in accordance with Article L. 121-21-8 12° of the French Consumer Code, that they do not have the right of withdrawal provided for in Article L. 121-21 of the French Consumer Code. The terms and conditions of sale for the reserved rate specify the cancellation and/or modification procedures. Reservations made with a deposit or prepayment cannot be modified. Advance payments are non-refundable. This is stated in the rate's terms and conditions. When permitted by the reserved rate's terms and conditions, reservations can be cancelled directly with the establishment, whose telephone and email contact details are provided on the booking confirmation sent by email. All reservations are non-transferable and cannot be assigned to a third party, whether free of charge or for payment.

Refund service according to the guarantees of cancellation insurance subscription.

Any reservation for which the deposit payment is made via a secure link and not confirmed by the customer will result in the cancellation of the reservation at the customer's expense.


6. Consumption of the service

In accordance with regulations in certain countries, guests may be asked to complete a police registration form upon arrival. To this end, guests will be asked to present identification to verify whether or not they are required to complete the form. Any behavior contrary to public decency and order will result in the establishment asking the guest to leave without any compensation or refund, even if payment has already been made. As the establishment has internal regulations, the customer accepts and agrees to abide by said regulations. If the customer fails to comply with any provision of the internal regulations, the establishment will be obliged to ask the customer to leave the premises without any compensation or refund, even if payment has already been made.

INTERNAL REGULATIONS:

Upon entering the establishment, you acknowledge that you will strictly comply with the establishment's internal regulations.

VALUABLES: Management is only responsible for valuables or cash deposited at reception against receipt.

HOTEL NOTES: Bills are settled upon arrival. For longer stays, payment can be made at the beginning of each week. Services and extras are payable at the time of booking.

KEYS: Rooms must be kept locked and keys returned to the hotel reception upon departure. You may keep the keys with you during your stay, but you become fully responsible for them.

ELECTRICITY: The power supply at the outlet is 220 volts. Out of respect for the environment, it is forbidden to plug in any heating/air conditioning appliances, coolers, or other similar devices in the rooms.

WATER MANAGEMENT: Out of respect for the environment, washing clothes in the rooms is prohibited. Please ensure that the taps are turned off completely after use.

HYGIENE: Any observation requiring additional waste management and cleaning services will incur a charge of €30 per day on top of your stay. A waste collection point is located a 5-minute walk towards the beach.

SWIMMING POOL: For safety and hygiene reasons, and to limit nuisances (insects), it is strictly forbidden to drink, eat, or smoke within the pool area and wellness area. Restrooms are available. and a shower are available for your use.

Wellness area open from Easter to All Saints' Day.

Out of respect for the environment and our resources, the pool is heated when the outside temperature allows swimming (mainly from June to September).

We thank you for letting us know your wishes or regrets regarding the proper functioning of the establishment's services.

Management reserves the right to charge for any damage, deterioration, nuisance and non-compliance with regulations observed during your stay or upon your departure.


7. Responsibility

The photographs shown on our booking platform are not contractual (all our rooms have different exposures, colours, and furnishings. Changes may occur due to necessity). Although all photographs, graphic representations, and texts are intended to illustrate the establishments presented, and while they provide as accurate a representation as possible of the services offered, variations may occur between the time of booking and the day the service is used. The establishment cannot be held liable for the non-execution or improper execution of the booking in cases of force majeure, actions of third parties, or actions of the client, including but not limited to internet network unavailability, inability to access the website, external intrusion, computer viruses, or unauthorized prepayment by the cardholder's bank. Any booking or payment that is irregular, invalid, incomplete, or fraudulent for a reason attributable to the client will result in the cancellation of the order at the client's expense.

Claims relating to the non-performance or poor performance of the services booked must, under penalty of forfeiture, be brought to our attention in writing within eight days after the date of departure from the establishment.


8. Price

The prices for booking services are displayed before and during the booking process. Prices are confirmed to the customer inclusive of all taxes, in euros, and are valid only for the period indicated on the booking platform. If payment is made at the establishment in a currency other than the one confirmed on the booking, the exchange fees are the responsibility of the customer. All bookings, regardless of origin, are payable in the establishment's local currency, unless otherwise specified on-site. Unless otherwise stated on the booking platform, additional services are not included in the price.Any applicable taxes (local taxes, tourist taxes, etc.), listed on the rates page, are payable directly to the establishment upon arrival. Prices include VAT at the rate applicable on the date of booking, and any change in the applicable VAT rate will be automatically reflected in the prices shown on the invoice date. Any modification or introduction of new legal or regulatory taxes imposed by the relevant authorities will also be automatically reflected in the prices shown on the invoice date.


9. Payment

The customer provides their bank details as a guarantee for the reservation, special conditions, or rates that require a deposit or prepayment, by credit card (Visa, Mastercard) by directly entering the card number, without spaces between the digits, its expiry date (it is specified that the bank card used must be valid at the time of service), and the security code in the designated area (secure entry via SSL encryption). The customer must present the bank card used to guarantee the reservation at the establishment. Payment is debited at the establishment during the stay, except in the case of special conditions or rates where partial or full payment is debited at the time of booking. This prepayment is considered a deposit. In the event of a no-show (reservation not cancelled – guest not present) for a reservation guaranteed by credit card, the establishment will charge the guest, as a fixed penalty, the amount indicated in its general and specific terms and conditions of sale. The establishment has chosen elloha.com and PAYZEN to secure online credit card payments. The validity of the guest's payment card is verified. A payment card may be declined for several reasons: stolen card, blocked card, spending limit reached, incorrect entry, etc. In case of a problem, the guest should contact their bank and the establishment to confirm their reservation and payment method. For rates requiring online prepayment, the advance payment, which constitutes the deposit, is debited at any time after the reservation.


10. Respect for privacy

On each personal data collection form, the customer is informed whether responses are mandatory or optional by the presence of an asterisk. The information processed is intended for the establishment, elloha.com, its entities, its partners, and its service providers (including online payment providers). The customer authorizes elloha.com to share their personal data with third parties, provided that such sharing is compatible with the performance of operations incumbent upon elloha.com under these terms and conditions and in accordance with the Customer Personal Data Protection Charter. In particular, during online payment, the customer's bank details must be transmitted by the payment provider stripe.com to the establishment's bank for the execution of the booking contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection as defined by the French Data Protection Act (Loi Informatique et Libertés). However, the client consents to this transfer, which is necessary for the execution of their reservation. Constellation SAS, in its professional capacity, has committed to the establishment to take all necessary security measures and ensure the confidentiality of data for these data transfers.


Entering the required bank details, along with accepting these terms and conditions and the booking confirmation or request, constitutes an electronic signature which, between the parties, has the same legal value as a handwritten signature. The computerized records stored in the elloha.com computer systems will be kept under reasonable security conditions and considered proof of communications, orders, and payments between the parties. The customer is informed that their IP address is recorded at the time of booking.


11. Dispute Resolution

These General Terms and Conditions of Sale are governed by the law of the country of establishment without prejudice to any mandatory protective provisions that may apply in the country of residence of the consumers.


These General Terms and Conditions of Sale, the terms and conditions of the rate booked by the customer, and the booking confirmation or request constitute the entire agreement between the parties. No general or specific terms and conditions communicated by the customer may be incorporated into these General Terms and Conditions. The documents forming the contractual commitments between the parties are, in descending order of priority, the booking confirmation or request (including the specific terms and conditions of the reserved rate) and these General Terms and Conditions. In the event of any conflict between the booking confirmation and the General Terms and Conditions, the provisions of the booking confirmation shall prevail with respect to the obligation in question. These online terms and conditions of sale may be modified and/or supplemented by the establishment at any time. In this case, the new version of the online terms and conditions of sale will be published online by the establishment. Once published online, the new version of the online terms and conditions of sale will automatically apply to all customers.
